How to start a company in Poland. Part 1: What kind of companies can be run in Poland by foreigners?

The first question that may come to your mind, when you decide to open a business in Poland is probably: “is it even possible to establish and run a company in Poland by a foreigner?”

The short answer is: yes, it is possible for every foreigner to start a company and it doesn’t require much more paperwork than in case of Polish citizens.

Still, not all types of companies are available to all foreigners. Depending on what country are you from and what is your residence status, you may be allowed to start different types of companies.

In next articles, I will describe you specifics about each type of company in Poland. For this week’s topic, we will present what kind of companies can be started, depending on your situation.

 

Your legal status

What companies can you run in Poland

o   European Union citizen

o   Norway citizen

o   Sweden citizen

o   Switzerland citizen

You can start any company on the same terms as Polish citizens, including:

  • jednoosobowa działalność gospodarcza (sole trader/self-employment)
  • spółka cywilna (civil law partnership)
  • spółka jawna / sp.j. (general partnership)
  • spółka partnerska / sp.p. (professional partnership)
  • spółka komandytowa /sp.k. (limited partnership)
  • spółka komandytowo-akcyjna / S.K.A. (limited joint-stock partnership)
  • spółka z ograniczoną odpowiedzialnością / sp. z o.o. (limited liability company)
  • spółka akcyjna / S.A. (limited liability company)

o   permanent residence permit

o   long term EU residence permit

o   temporary residence permit granted for the purpose of studying

o   temporary residence permit granted for the purpose of family reunion

o   temporary residence permit granted on the basis of marriage to a Polish citizen

o   temporary residence permit granted on the basis of marriage to a foreigner who has a long term EU residence

o   temporary residence permit for the purpose of conducting business activity, granted in connection with the continuation of business activity already conducted

o   refugee status

o   subsidiary protection

o   temporary protection in Poland

o   Polish Card

You can start any company on the same terms as Polish citizens, including:

  • spółka akcyjna / S.A. (limited liability company)
